Terms of Service

Far Enough gives conservative fuel and range estimates to help you plan a trip — a planning aid, not a guarantee of what happens on the water. By using the app you accept these terms, including the disclaimers and assumption of risk below.

This summary is a reading aid, not part of the agreement — the full terms below are what governs.

These Terms of Service are entered into between you and The Sorskod LLC, a Maryland registered company, the owner and provider of the Far Enough mobile application, website, and related services. References to “Far Enough,” “the app,” “we,” “us,” and “our” mean The Sorskod LLC, unless the context requires otherwise.

1. Acceptance of Terms

By downloading, accessing, or using Far Enough, you agree to be bound by these Terms of Service. If you do not agree, you must not download, access, or use the app.

Before first use, the app presents a mandatory disclaimer that must be acknowledged on the device. That disclaimer is also available in the app settings. By using the app, you acknowledge that Far Enough is a planning aid only and that you remain solely responsible for all boating, navigation, fuel, safety, weather, and operational decisions.

You must be at least 18 years old to use the app. If you use the app on behalf of a vessel owner, company, organization, or other person, you represent that you have authority to do so.

2. App Purchase and App Store Terms

Far Enough is currently offered as a one-time pay-to-download mobile application. There is no subscription and no in-app purchase unless separately disclosed in the applicable app store listing.

Purchases are processed by the Apple App Store or Google Play, as applicable. The Sorskod LLC does not receive or store your full payment-card or billing information. Your purchase may also be subject to the applicable store’s terms, conditions, refund rules, and privacy practices.

To the extent there is a conflict between these Terms and the applicable app store terms regarding payment processing, refunds, billing, device rules, or app-store account requirements, the applicable app store terms may control that transaction-specific issue.

3. Planning Aid Only; No Guarantee

Far Enough is a marine fuel and trip-planning aid. It provides modeled estimates based on user inputs, app calculations, available data, and third-party or derived data sources.

Far Enough does not provide guarantees, actual fuel measurements, navigation instructions, safety determinations, emergency monitoring, distress services, search-and-rescue services, or operational commands.

Any fuel burn, range, reserve, trip feasibility, tide, weather, speed, engine, route, position, or other information displayed in the app may be estimated, modeled, incomplete, delayed, inaccurate, stale, miscalibrated, unavailable, or unsuitable for your specific vessel, route, or conditions.

You must never treat any number, alert, estimate, route, range, reserve, confidence level, chart image, tide estimate, weather information, sensor reading, GPS position, or float-plan feature as a guarantee, actual measurement, navigation instruction, safety determination, or substitute for your own judgment.

4. Skipper Responsibility and Assumption of Risk

Boating involves inherent and significant risks, including fuel exhaustion, stranding, grounding, collision, capsizing, mechanical failure, weather-related danger, injury, death, property damage, environmental damage, rescue costs, towing costs, and salvage costs.

You are the skipper and remain solely responsible for your vessel, passengers, crew, fuel supply, reserve fuel, route, navigation, safety equipment, vessel condition, weather decisions, tide decisions, speed, seamanship, emergency planning, and all operational decisions.

You agree to carry adequate reserve fuel, monitor working gauges, use official charts and navigation tools, check current marine weather and tide conditions through official and appropriate sources, maintain your vessel and equipment, and exercise ordinary maritime judgment.

You assume all risks arising from your use of the app and from any boating decision made before, during, or after using the app.

5. Not for Navigation

Far Enough is not a navigation system, chartplotter, Electronic Chart Display and Information System, ECDIS, distress system, emergency system, search-and-rescue system, vessel-monitoring system, safety system, professional maritime service, mechanical advisory service, meteorological advisory service, or legal advisory service.

The app must not be used as your primary or sole source of information for navigation, fuel decisions, weather decisions, route planning, emergency response, or vessel operation.

You must use official charts, notices to mariners, navigation instruments, working vessel gauges, current weather sources, tide sources, and your own independent judgment.

6. NOAA-Derived Chart Disclaimer

Chart imagery in the app is provided for general planning context only. Chart imagery is not an official NOAA chart, is not for navigation, and must not be used as a substitute for official charts, notices to mariners, navigation instruments, or the judgment of the vessel operator.

Certain chart imagery may be derived from data made available by the National Oceanic and Atmospheric Administration or its Office of Coast Survey. The Sorskod LLC is not affiliated with, sponsored by, endorsed by, or approved by NOAA or any other government agency.

The chart imagery may be incomplete, outdated, inaccurate, unavailable, or unsuitable for any particular route, vessel, location, or condition. Chart coverage is limited to supported U.S. coastal waters only. Chart imagery may not be available for non-U.S. waters or unsupported areas.

The chart data used by the app is based on a fixed data snapshot from May 2024 and is not updated in real time. You are responsible for consulting official and current navigation sources.

7. Weather, Tide, and Third-Party Data Disclaimer

Weather, tide, geocoding, place-search, chart, and other app information may be modeled, derived from third-party data, delayed, incomplete, inaccurate, unavailable, or subject to change without notice.

Weather and tide information displayed in the app is provided for general planning context only and is not navigation-grade, safety-grade, or guaranteed to reflect actual or future conditions.

You must independently verify all weather, tide, route, fuel, and safety information through official and appropriate sources before departure and during vessel operation.

8. Live Boat-Network Data Disclaimer

The app may optionally connect over a local boat network to display information from a vessel’s NMEA 2000, SignalK, or other compatible gateway. This feature is provided for convenience only.

Live boat-network data may be wrong, stale, delayed, unavailable, incomplete, miscalibrated, incorrectly configured, or affected by sensor, network, gateway, software, installation, or vessel issues.

The app does not independently verify or measure your actual fuel, engine condition, speed, position, tank level, or vessel status. You remain responsible for verifying all information through working vessel instruments, physical checks, and appropriate operating procedures.

9. Float Plan Disclaimer

Float plan features are provided only as a convenience. The app does not monitor your voyage, confirm your departure, confirm your arrival, notify emergency authorities, provide distress services, provide emergency response, or serve as a search-and-rescue system.

You are solely responsible for creating, reviewing, updating, and sharing any float plan. You are also responsible for arranging appropriate check-ins, emergency contacts, and safety procedures outside the app.

A shared float plan does not guarantee that any person will receive, review, monitor, or act on the information.

10. User Inputs and Local Device Data

The accuracy and usefulness of app estimates depend on the information you enter and the data available to the app. You are responsible for entering accurate vessel, engine, tank, route, speed, refuel, and trip information.

Boat, trip, refuel, and float-plan data are stored locally on your device unless you choose to share that information through a device feature or external service. The Sorskod LLC does not maintain user accounts or server-side user profiles for the app.

11. Prohibited Uses

You may not use the app in any unlawful, unsafe, abusive, or unauthorized manner. You may not use the app to violate maritime rules, navigation requirements, safety requirements, intellectual-property rights, privacy rights, or applicable law.

You may not reverse engineer, copy, modify, scrape, interfere with, or misuse the app, website, servers, APIs, map tiles, geocoding endpoint, weather proxy, or related infrastructure except as permitted by law.

12. No Warranty

To the fullest extent permitted by law, Far Enough, the website, and all related services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.

The Sorskod LLC disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, uninterrupted operation, error-free operation, data accuracy, safety, navigation suitability, and suitability for any particular vessel, route, condition, or use.

The Sorskod LLC does not warrant that the app will be accurate, current, complete, available, uninterrupted, secure, error-free, compatible with your vessel, compatible with your devices, compatible with your sensors, or suitable for any boating, navigation, safety, emergency, weather, fuel, or operational purpose.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions apply only to the fullest extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, The Sorskod LLC and its owners, members, managers, officers, employees, contractors, agents, affiliates, licensors, service providers, and suppliers shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including loss of profits, loss of data, loss of goodwill, business interruption, trip interruption, or other intangible losses.

To the fullest extent permitted by law, The Sorskod LLC shall not be liable for stranding, towing, salvage, rescue costs, fuel exhaustion, vessel damage, engine damage, equipment damage, grounding, collision, personal injury, death, environmental damage, fines, penalties, inaccurate estimates, inaccurate data, unavailable app functions, sensor errors, GPS errors, stale or delayed readings, or reliance on app outputs.

To the fullest extent permitted by law, the total liability of The Sorskod LLC and its owners, members, managers, officers, employees, contractors, agents, affiliates, licensors, service providers, and suppliers for any claim arising out of or relating to the app, website, services, or these Terms shall not exceed the amount you paid to download the app.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded, including liability for death or personal injury caused by negligence where applicable law prohibits such limitation or exclusion.

14. Release and Indemnity

To the fullest extent permitted by law, you release The Sorskod LLC and its owners, members, managers, officers, employees, contractors, agents, affiliates, licensors, service providers, and suppliers from claims, liabilities, losses, damages, costs, and expenses arising from your use of the app or reliance on app information.

You agree to indemnify and hold harmless The Sorskod LLC and its owners, members, managers, officers, employees, contractors, agents, affiliates, licensors, service providers, and suppliers from and against any claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your use or misuse of the app, your vessel operation, your violation of these Terms, your violation of law, or your violation of any third-party rights.

15. Intellectual Property and Attribution

The app, website, software, design, text, graphics, trademarks, service marks, logos, and other content owned by The Sorskod LLC are protected by intellectual-property and other laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the app or related materials.

Certain data, map, weather, chart, geocoding, or other informational components may be derived from public, open, licensed, or third-party sources. OpenStreetMap and its contributors are credited as required by applicable OpenStreetMap attribution requirements. NOAA-related data, where used, is identified for attribution and context only and does not imply endorsement by NOAA or any government agency.

16. Changes to the App or Terms

The Sorskod LLC may update, modify, suspend, or discontinue the app, website, features, data sources, or these Terms at any time. Continued use of the app after changes are posted or made available constitutes acceptance of the updated Terms.

If you do not agree with updated Terms, you must stop using the app.

17. Governing Law

These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms, the app, the website, or any related services, shall be governed by the laws of the State of Maryland, without regard to its conflict-of-law rules.

Nothing in these Terms limits any consumer rights that cannot be waived under the laws of the jurisdiction where you reside.

18. Mandatory Arbitration and Class Action Waiver

You and The Sorskod LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Far Enough app, the website, any related services, or any communications between you and The Sorskod LLC shall be resolved by binding individual arbitration, rather than in court, except as expressly provided below.

The arbitration shall be conducted on an individual basis only. You and The Sorskod LLC waive any right to bring or participate in any class action, collective action, private attorney general action, or other representative proceeding.

You and The Sorskod LLC also waive the right to a jury trial for any dispute that is subject to arbitration or that proceeds in court.

Unless otherwise required by applicable law, the arbitration shall be administered by the American Arbitration Association under its applicable consumer arbitration rules. The arbitration shall take place in Maryland, unless the arbitrator permits remote participation or determines that another location is required by applicable law.

This arbitration provision does not prevent either party from bringing an individual claim in small claims court where permitted by law. It also does not prevent The Sorskod LLC from seeking temporary, preliminary, or permanent injunctive relief for intellectual-property misuse, unauthorized access, misuse of the app, or other conduct that may cause immediate or irreparable harm.

If any portion of this arbitration provision is found unenforceable, the unenforceable portion shall be severed, and the remaining portions shall remain in effect to the fullest extent permitted by law.

19. Apple-Specific Terms

If you downloaded the app from the Apple App Store, the following additional terms apply:

These Terms are between you and The Sorskod LLC, not Apple Inc.

Apple is not responsible for the app, its content, maintenance, support, warranties, product claims, intellectual-property claims, or legal compliance claims.

The Sorskod LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of the app, including product-liability claims, legal or regulatory claims, and claims arising under consumer-protection, privacy, or similar laws.

You must comply with applicable third-party terms when using the app.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.
